Kimberly McCarthy gets a 60 day stay of execution

Just hours before her scheduled execution, Kimberly McCarthy received a stay until April 3rd, 2013.

State District Judge Larry Mitchell approved McCarthy’s attorneys request for a stay, they appealed for more time to prepare a case that the jury that convicted and sentenced her to death was improperly selected based on race; the jury was mostly white.

If executed, McCarthy will only be the 4th woman inTexas executed since the death penalty was re-instated in 1976.

Hines was executed this evening in Texas.

Bobby Lee Hines was executed this evening for the murder of 26-year-old Michelle Wendy Haupt more than 20 years ago.

Hines was 40 years old at the time and was on probation when he stabbed the 19-year-old 18 times and then strangled her. He was her next door neighbour in an apartment complex. Hines was tried and convicted in 1991 for her murder.

Hines’ original execution date was set in 2003 but for almost a decade the courts have been filled with appeals based on his mental capacity. In 2012 another execution date was set for May, but again his execution was delayed when he won an stay while DNA evidence was tested. But it would only delay the inevitable. The tests confirmed Hines’ guilt and his last execution date was set for today.

 

Cleve Foster executed in Texas

cleve foster execution: crimeticker.comTexas inmate Cleve Foster, who faced the death chamber three times and escaped with his life lost his fourth battle tonight when he was executed by lethal injection.

The former Army recruiter was convicted in the death of Nyaneur Mary Pal, a woman he and a friend had met in a Fort Worth bar 10 years ago. Pal was a 30-year old immigrant from Sudan. She was shot in the head and then dumped in a ditch – Valentine’s day 2002. Foster and his attorneys both insisted that he was innocent and that it was faulty lawerying that caused him to lose the case.

As the drugs began to flow Foster uttered his last words, “When I close my eyes, I”ll be with the father, God is everything. He’s my life. Tonight I’ll be with him.” He then turned to the victim’s family, “I don’t know what you’re going to be feeling tonight. I pray we’ll all meet in heaven.”

Foster was pronounced dead at 7:43 PM EST.

 

Third time might not be a charm for Texas inmate facing execution tomorrow

Texas inmate Cleve Foster will face lethal injection tomorrow for the third time in 2 years. Foster has twice before been standing at the door of the death chamber when the U.S. Supreme Court has intervened and given him a stay of execution.

Foster was convicted of murdering Nyanuer “Mary” Pal, a Sudanese immigrant near Fort Worth, Texas. Even with DNA evidence tying him to the crime, Foster continues to maintain his innocence. His lawyers though are fighting his case based on ineffective counsel in his 2004 trial.

 

Texas to host next execution on August 22nd

Balentine’s execution is scheduled for August 22nd.

The next scheduled execution in the United States will be on Wednesday next week in Texas.

John Balentine was given the death sentence for the triple murder of Edward Caylor, 17-years-old, Kai Geyer, 15-years-old and Steven Watson, 15-years-old in Amarillo, Texas in 1999. Ballentine broke into the house where the three teenagers were sleeping and shot each one of them in the head. Reportedly Balentine had been dating Caylor’s sister and an argument had caused some bad blood.

Balentine’s attorney, Lydia Brandt, filed for a stay of execution claiming that due to ineffective counsel, the sentencing phase of his trial did not include any information about his extremely abusive and violent childhood – information, Brandt suggested, may have convinced the jury to choose life in prison. This is the third attempt by Brandt to halt her client’s execution.
