Texas inmate Marvin Lee Wilson next scheduled execution
After 18 years on death row, Marvin Lee Wilson, 54-years-old, is scheduled to die on Tuesday, August 7th for the murder of Jerry Robert Williams in 1992.
Wilson’s appeals follow the same path as several inmates this year who claim that they should not be executed because of their mental disabilities. Wilson reportedly has an IQ of 61 – which if true, puts him in the legal territory of mentally disabled and has been diagnosed as “mentally retarded” by Dr. Donald Trahan, a certified neuropsychologist.
Wilson’s legal team currently has a petition before the Texas Board of Pardons and Paroles which asks for a commutation of his sentence from death to life in prison without the possibility of parole.
In 2002 the Unites States Supreme Court ruled that executing “mentally retarded” criminals constitutes “cruel and unusual punishment” and therefore they are exempt from the harshest penalty under law. However, the court did not outline any standards by which states can measure the level of mental disability, therefore leaving the determination as a grey area.
